End User License Agreement

1. Eligibility and Accounts

• You must be at least 14 years old to use FoShape. If you are under the age of majority in your jurisdiction, you may only use the services with the consent and supervision of a parent or legal guardian.
• You agree to provide accurate registration information, keep your credentials confidential, and notify us or your sign-in provider about unauthorized access.
• You are responsible for obtaining compatible hardware, connectivity, and security software needed to use FoShape.

2. License Grant and Restrictions

• FoShape grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the services for personal, non-commercial wellness tracking.
• You may not copy, modify, reverse engineer, bypass security controls, scrape the service, or remove proprietary notices except where mandatory law allows it.
• FoShape retains all intellectual property rights in the software, documentation, design systems, and brand assets.

3. FoShape Features and Acceptable Use

• FoShape may provide meal logging, AI-powered dish recognition, nutrition analysis, reminders, device sync, and integrations with platform services.
• AI recognition, nutrition guidance, and health indicators are estimates and should always be reviewed before you act on them.
• You may not upload unlawful, abusive, infringing, or harmful content, or use FoShape in ways that endanger others.
• We may rate-limit or restrict access when necessary to protect system integrity and investigate suspicious behavior.

4. User Content and License

• You retain ownership of photos, annotations, comments, and other content you submit.
• By uploading content, you grant FoShape and its processors a worldwide, royalty-free license to host, process, analyze, adapt, and display it solely to provide and improve the service and comply with legal obligations.
• You represent that you have the rights needed to submit your content, and FoShape may remove content that appears to violate this agreement or the law.

5. Subscriptions, Free Trials, and Payments

• FoShape may offer free tiers, trials, or paid plans that unlock additional analysis, retention, or coaching features.
• Paid plans renew automatically unless canceled through the storefront or account portal before renewal.
• Taxes, exchange fees, and price changes may apply, and refunds are handled according to the applicable storefront policies and local consumer law.

6. Health and Safety Disclaimer

Calorie estimates, health metrics, and recommendations may not be suitable for pregnant individuals, people with chronic diseases, children, or users with special dietary requirements.

7. Privacy and Permissions

• Your use of the services is also governed by the FoShape Privacy Policy.
• Some features require access to device sensors, media libraries, notifications, or third-party accounts.
• You are responsible for keeping your contact details current so we can reach you about security, legal, or billing matters.

8. Third-Party Services and Links

• FoShape may integrate with services from Apple, Google, Firebase, payment gateways, cloud hosts, or other partners.
• If you connect third-party accounts such as HealthKit or Google Fit, you authorize FoShape to exchange data with those services as described in our privacy policy.
• Any third-party educational resources or external links are provided for convenience only.

9. Updates, Beta Features, and Support

• FoShape may automatically download and install updates, patches, or new modules.
• Beta or preview features may have reduced reliability and may be discontinued at any time.
• Support is available through the in-app Help and Feedback channel or by email.

10. Termination and Suspension

• You may stop using FoShape at any time by deleting your account where available and uninstalling the application.
• We may suspend or terminate access if you breach this agreement, violate applicable law, fail to pay required fees, or create security or regulatory risk.
• Terms that should survive termination, such as license restrictions, disclaimers, payment obligations, and dispute provisions, will remain effective.

11. Warranties, Disclaimers, and Limitation of Liability

FoShape’s total liability arising out of or relating to the services will not exceed the amount you paid for access during the 12 months before the claim, or US$100, whichever is greater, unless local law requires otherwise.

12. Indemnification

You agree to indemnify and hold harmless FoShape, its affiliates, licensors, and partners from claims, losses, liabilities, damages, costs, and expenses arising out of your content, misuse of the services, violation of this agreement, or infringement of third-party rights.

13. Governing Law and Dispute Resolution

• For users primarily accessing the CN edition within Mainland China, this agreement is governed by the laws of the People’s Republic of China and disputes may be submitted to the competent people’s court at FoShape’s principal Chinese operating location after good-faith consultation.
• For all other users, this agreement is governed by the laws of your habitual residence without regard to conflict-of-law principles, and disputes may be resolved by the courts located in your residence.
• Nothing in this section deprives you of protections afforded by mandatory consumer laws in your jurisdiction.

14. Changes to this EULA

We may update this agreement to reflect feature changes, legal requirements, or security improvements. Continued use of FoShape after the effective date of an updated agreement constitutes acceptance of the changes.
